Healthcare Defense

Healthcare defense has been our focus since the firm was founded. We represent long-term care facilities, doctors, assisted living facilities, hospice providers, home health providers, nurses, healthcare professionals, and emergency departments in professional and institutional negligence claims and regulatory and license proceedings.

Carden & Tracy represents nursing homes, shelter care facilities, hospice care facilities, and assisted living facilities, home health providers as well as their personnel, in civil litigation on cases related to negligence and violations of the Illinois Nursing Home Care Act and OBRA regulations. With thorough knowledge of the Illinois Nursing Home Care Act and a keen understanding of the standards and regulations affecting clients’ businesses, our success at both the trial and appellate level is a direct reflection on this concentrated experience. The firm’s staff of attorneys is in the vanguard of this rapidly evolving landscape, providing insight and advice on the latest standards, regulations and rulings.

Our lawyers have defended cases filed against doctors, physician assistants, and emergency departments. Our attorneys have extensive experience serving these clients in a variety of settings—including nursing homes, hospitals, and home healthcare—leading us to produce a verdict and settlement record well above industry standards.

General Liability Defense

Our attorneys have successfully litigated cases related to construction, products, transportation, premises, and first-party at both the trial and appellate level.

Products Liability

Our firm’s experience working for product insurers across the U.S. is both wide and deep. We litigate cases for and against manufacturers, distributors, and sellers in claims involving strict liability, negligence, and breach of warranty, including catastrophic losses and mass tort claims.

Premises Liability

Premises liability is one of the most highly developed areas of tort law. The reported cases and statutes offer our creative, aggressive defense lawyers many tools to successfully defend cases in both motion court and the courtroom. Our attorneys have defended virtually every conceivable type of property owner and user in court, developing a proven track record of settlements and trials that instills a high level of confidence with our property liability clients. Taking advantage of the favorable case law and positive attitudes from juries that make for excellent defense weapons, we are often victorious in motions for summary judgment and therefore recommend aggressively defending these cases at all stages of the case.

Regulatory Compliance

Our firm develops and implements comprehensive regulatory compliance and reporting programs, as well as in-servicing programs, for compliance officers.

The firm has experience in interpreting and litigating insurance coverage matters across the entire line of ISO standard and non-standard coverage forms, serving as coverage counsel to major national and international insurers and reinsurance companies. Our attorneys have successfully litigated a wide range of coverage-related issues involving liability, environmental, life, and specialty lines policies. We have provided carriers with an extensive range of coverage opinions and support in personal, commercial, and specialty lines of business, as described above.

Commercial Litigation

We have a team dedicated to commercial litigation that focuses on favorable and economic resolutions to contract claims, partnership disputes, consumer fraud cases, and more.

Carden & Tracy’s Commercial Litigation team represents businesses and individuals before state and federal courts as well as administrative agencies and arbitration panels. Our attorneys work with our clients’ in-house legal and business teams to understand their business and litigation objectives, always aiming to achieve favorable and economic resolutions that are in our clients’ best interests. We have successfully litigated contract claims, partnership disputes, enforcement and defense of restrictive covenants, and fraud claims.
